These Terms of Use (“Terms”) govern your access to and use of lumelcoaching.com and any related platforms, content, or services offered by Liminalis Group LLC d/b/a Lumel Coaching (“Lumel Coaching,” “we,” “our,” or “us”). By using this Site or engaging in any coaching services provided by Catherine Borda de Castro or any Lumel Coaching coach (collectively, the “Coaches”), you agree to be bound by these Terms.
If you do not agree with these Terms, please do not use the Site or participate in our services.
1. Coaching Services
Lumel Coaching provides professional coaching services designed to support personal and/or professional growth, self-awareness, and goal achievement. Coaching may include identifying goals, exploring patterns, creating strategies, and supporting accountability.
Coaching is not therapy, not mental health treatment, and not a substitute for professional medical, legal, financial, or psychological advice. You are solely responsible for your decisions, actions, and results.
By engaging in coaching services, you acknowledge:
- Coaching does not diagnose, treat, or prevent mental disorders.
- Coaching may involve all areas of your life, and decisions are solely your responsibility.
- You maintain full responsibility for your physical, mental, and emotional well-being.
- No specific results or outcomes are guaranteed.
2. User Content
“User Content” includes any materials you submit to Lumel Coaching or through the Site, including forms, reflections, messages, testimonials, session materials, or other communications.
By submitting User Content, you confirm:
- You own your content or have rights to share it.
- Your content does not violate any law or infringe on any third-party rights.
- You are fully responsible for your content and assume all associated risks.
License to Use Content:
By submitting content, you grant Lumel Coaching a nonexclusive, royalty-free, worldwide license to store, use, and display your content as needed to operate the business, deliver coaching services, maintain records, and improve client experience.
Testimonials may be used for marketing with your consent.
We do not guarantee backups of any User Content. You should maintain your own records.
3. Acceptable Use Policy
You agree not to:
- Upload unlawful, abusive, defamatory, obscene, or infringing content.
- Share harmful software, viruses, or malicious code.
- Spam, solicit, or harvest data from other users.
- Interfere with the functioning or security of the Site or coaching platform.
- Use bots or automated tools to access or disrupt the Site.
We may remove or restrict content or access at our discretion.
4. Confidentiality
Lumel Coaching respects your privacy. All client information shared during coaching is treated as confidential except in the following circumstances:
- When disclosure is required by law, subpoena, or court order
- When the Coach reasonably believes you or another person is at risk of harm
- When illegal activity is disclosed
- When information is already public or independently obtained
- When information relates to general coaching methodologies, frameworks, or insights that are not identifiable to you
Digital communication tools—including email, Zoom, and management platforms—come with inherent security risks. Absolute confidentiality cannot be guaranteed.
Session notes are the property of Lumel Coaching and may be stored for at least one year. Upon request, session notes may be provided or destroyed within that time frame.
5. Intellectual Property
All materials, coaching methodologies, frameworks, tools, documents, and content created by Lumel Coaching or the Coaches are the exclusive property of Lumel Coaching.
You may not copy, distribute, reproduce, or adapt any proprietary materials without written consent.
User Content remains yours, but all intellectual property created by Lumel Coaching is ours.
6. Payments, Cancellations & Scheduling
Fees for coaching services must be paid in advance or on an approved installment schedule.
You agree to:
- Provide at least 24 hours notice to cancel or reschedule a session
- Pay for late-cancelled or missed sessions
- Use the designated coaching platform for scheduling, communication, and invoicing
Improperly cancelled sessions (including no-shows or unpaid sessions) may be billed at full cost.
7. Disclaimers
The Site and coaching services are provided “as is” without warranties of any kind, express or implied.
Lumel Coaching does not guarantee:
- Specific outcomes
- Accuracy or reliability of Site content
- Uninterrupted or error-free Site performance
Coaching does not replace therapy, medical care, legal advice, or professional counseling.
You are responsible for seeking appropriate professional support when needed.
8. Limitation of Liability
To the fullest extent permitted by law:
Lumel Coaching and the Coaches are not liable for indirect, incidental, or consequential damages, including lost profits, emotional distress, or business interruption.
Total liability will not exceed the amount you paid for coaching services during the most recent session period.
You accept full responsibility for your choices, actions, and results.
9. Indemnification
You agree to indemnify and hold harmless Lumel Coaching, Liminalis Group LLC, Catherine Borda de Castro, and all Coaches from any claims, losses, damages, liabilities, or expenses arising out of:
- Your use of the Site or services
- Your violation of these Terms
- Your actions, decisions, or results connected to coaching
10. Termination
Lumel Coaching reserves the right to terminate your access to the Site or coaching relationship at any time, including for:
- Nonpayment
- Violations of these Terms
- Behavior deemed unsafe, inappropriate, or disruptive
- Misuse of content or intellectual property
Upon termination, you remain responsible for all completed or late-cancelled sessions.
11. Dispute Resolution
Any disputes arising from these Terms or coaching services shall be resolved through binding arbitration in Fulton County, Georgia, under JAMS, AAA, or another mutually agreed-upon ADR provider.
Actions must be filed within one (1) year of the event giving rise to the claim.
12. Governing Law
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.
13. Modifications
Lumel Coaching may update, modify, or replace these Terms at any time. Updated Terms will be posted on the Site with a new effective date.
Your continued use of the Site or services constitutes acceptance of the updated Terms.
14. Third-Party Links
The Site may include links to external websites. Lumel Coaching is not responsible for the content, policies, or security of third-party sites.
15. Cookies
The Site may use cookies to enhance user experience and track engagement. You may disable cookies in your browser; however, some functionalities may not operate correctly.
16. Entire Agreement
These Terms represent the entire agreement between you and Lumel Coaching regarding Site use and coaching services. If a provision is found invalid, the remainder remains enforceable.
